Newton Quarter Horses Stallion Service Contract
This certifies ______________________________________, hereinafter referred to as the Mare Owner, has engaged one (1) breeding to _____________________________________________ for the Mare ____________________________________, Registration# _________________ for the 2008 breeding season in the amount of $750.00 U.S. dollars, subject to the following terms and conditions:
1. BOOKING FEE. A NON-REFUNDABLE booking fee of $250.00 (payable to Newton Quarter Horses) is due with this contract. A booking will not be guaranteed without the payment of the booking fee.
2. STALLION FEE. The contract balance of $450 (payable to Newton Quarter Horses) will be due and payable, at the time the Mare is checked in foal, leaves the farm, or, prior to shipment of Cooled Transported Semen, whichever occurs first.
3. PAYMENT. All unpaid expenses will normally be due and payable on the fifteenth (15th) day of each calendar month, following receipt of the customer's monthly statement from Newton Quarter Horses. All accounts must be paid IN FULL before a mare leaves the farm. The Breeder or Stallion Owner requires forty-eight (48) hours advance notice when the Mare Owner wishes to remove a mare from the farm, in order to allow sufficient time to prepare the final statement for payment by the Owner - Agent. The Stallion Owner or the Breeding Farm reserves the right to request a cashier's check for settlement of a Mare Owner's Account.
4. SERVICE CHARGE. All account balances are due IN FULL on or before the fifteenth (15th) day of each calendar month. Any account that is thirty (30) days or more past due will be subject to an fifteen percent (15%) per annum service charge which will be charged monthly. Additionally, any past due account may be placed for collection.
5. MARE RECORDS. A photo static copy of registration papers (both sides) is required for all mares, including mares to be bred by means of shipped semen. A veterinarian's health certificate, including uterine culture, worming and immunization records MUST be presented upon mare's arrival at the farm. If such records are not presented, the Breeder shall have the attending veterinarian make proper tests and evaluations at the expense of the Mare Owner. Flu, rhino, strangles and Potomac horse fever vaccines must be given before the mare arrives at the farm. A current Coggins test, as well as records of the aforementioned vaccines, shall be furnished upon delivery of the mare to the breeding farm. 6. MARE SETTLEMENT. The Breeder or Stallion Owner shall have sole discretion of determining the best method of breeding any mare. If, however, the mare does not settle, the Breeder and Stallion Owner shall be held harmless.
7. LIVE-FOAL GUARANTEE. Live foal means that the foal shall stand, nurse and live for 24 hours. It is understood that if the Mare proves barren, aborts her foal, or if the foal is stillborn, a return breeding will be guaranteed the following year, providing proper notification is given. Should the Mare prove barren, abort her foal, or produce a stillborn foal from the return-season breeding, a $250 chute fee will be required from the owner for future breeding. Proper notification shall be defined as follows: Written certification by a licensed veterinarian provided to Newton Quarter Horses within seven (7) days of the event indicating the reason(s) that the Mare slipped or produced a non-viable foal. The Mare Owner and Veterinarian must certify that such abortion or death did not result from any act, omission or negligence on the part of the Mare Owner after the Mare was checked and certified, "in-foal."
8. LIVE-FOAL QUALIFICATION. There will be no guarantee of a live foal for any mare leaving the Breeding Farm before being checked forty-five (45) days in-foal by the attending veterinarian unless otherwise agreed, in writing, by the parties hereto. Additionally, should an Owner's mare abort or produce a stillborn foal, Newton Quarter Horses may require veterinarian certification of immunization, worming and regumate records on the mare. There shall be no live foal guarantee if the Mare is not properly maintained during the pregnancy. Additionally, there shall be no live foal guarantee should the Mare be returned to training or be shown competitively.
9. REBREED REQUIREMENTS. The entire breeding fee must have been paid in full the previous breeding season. The Mare MUST BE at the breeding farm on or before April 1st unless otherwise agreed to IN WRITING by the parties.
10. WAIVER OF LIABILITY. It is understood and agreed that Newton Quarter Horses, Breeding Farm, the Farm Owners, its Employees, Veterinarians or Agents shall not be liable for any injury, escape, disability or death of any horse offered for breeding.
Additionally, the Mare Owner assumes the unavoidable risks inherent in all horse related activities and further agrees to indemnify and hold harmless Newton Quarter Horses, the Stallion Owner, Breeder, Veterinarian, Employees and all Family Members of each in connection with any type of loss or injury resulting from this Contract.
11. STALLION-MARE SUBSTITUTION. It is further agreed that should the above named stallion die or become unfit for service; or if the above named Mare should die during the breeding season, the Mare Owner may substitute another mare or breed the above named mare to another stallion on the farm that is agreed to, in writing, by both the Mare Owner and Newton Quarter Horses. Should the above named Mare die after being checked in-foal, the Breeder or Stallion Owner shall not be obligated in any way whatsoever to the Mare Owner once the Mare has left the Breeding Farm. If the Mare should die at the Breeding Farm after being checked in foal, the Mare Owner may substitute another Mare or may request a 50% refund of the Stallion Service Fee.
12. BREEDER'S
CERTIFICATE. A breeder's certificate will be issued to the Mare Owner upon
notification of the birth of the foal and after ALL expenses have been paid IN
FULL to the breeding farm, the farm's veterinarian and to Newton Quarter
Horses.
13. FEES. Daily Board: (Dry Mare) $6.50 / day; (Wet Mare) $8.50 day. The Mare
Owner will be responsible for the daily board and any other maintenance
expenses incurred by the Breeding Farm while the Mare is at said farm. The
board and maintenance expenses will be BILLED MONTHLY. Additionally, the Mare
Owner will be responsible for ALL fees and charges as billed by the farm's
veterinarian. Said veterinarian fees are due and payable upon receipt of the
aforesaid billing.
14. LOCATION. The Stallion will stand the 2006 breeding season at Newton Farm in Glasgow, Montana.
15. COOLED TRANSPORTED SEMEN: Additional Conditions for Mares Bred with Cooled Transported Semen may also be part of this contract if executed by the parties and attached hereto.
